NEW TAX LAW

NEW 1031 TAX LAW: On 10/22/04 President Bush signed into law corporate and foreign tax legislation that also contained a provision affecting IRC 1031. An Exchanger completes an exchange for a rental home that is held for investment & rents the property out for two years. The exchanger decides to move into their former rental house & live it in as their principal residence. Under the new law, the Exchanger will have to wait for at least three years before selling the principal residence & excluding gain under IRC 121.

LEGAL AND TAX QUESTIONS

How can you transfer your existing low tax rate when you buy your new home, how can you do it before age 55, when can you do it a second time & which counties will accept it? When can you qualify for the entire $500,00 capital gains exclusion EVEN IF you haven’t lived in your home for two out of the last five years & you’re unmarried? How can Sellers be exempt from capital gains that exceed $500,000? What disclosures give a buyer the right to cancel the transaction within 3 days if delivered in person? When a Buyer signs a Seller’s counter offer, has the buyer bought the house? What’s the difference between “as is” & “as was”?
